Impact Statement under section 104 (4) of the Environment Protection and Biodiversity Conservation Act 1999 The following notice is published pursuant to Section 104(4) of the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). Adani Mining Pty Ltd (Adani) has finalised the Environmental Impact Statement (EIS) for the proposed North Galilee Basin Rail Project (NGBR Project). The NGBR Project will provide for the transport of up to 100 million tonnes per annum of coal via approximately 311 km of new rail facilities. The NGBR Project will be situated in Queensland, generally traversing from the Carmichael Coal Mine and Rail Projects proposed rail infrastructure in the Galilee Basin (adjoining in the vicinity of Mistake Creek) to export facilities at the Port of Abbot Point. The NGBR Project was determined as a controlled action under the EPBC Act (EPBC Reference Number 2013/6885). As a result, Adani was required to undertake an assessment of potential environmental impacts relevant to Matters of National Environmental Significance (MNES) under the EPBC Act, having particular regard to the following provisions: World Heritage properties (sections 12 and 15A) National Heritage places (sections 15B and 15C) Listed threatened species and communities (sections 18 and 18A) Listed migratory species (sections 20 and 20A) Commonwealth marine areas (sections 23 and 24A)q Great Barrier Reef Marine Park (sections 24B and 24C) In accordance with section 103(3) of the EPBC Act, Adani released a draft EIS for the NGBR Project for public comment from 14 December 2013 - 11 February 2014. The period for comment is closed. The EIS has been finalised taking account of any comments received during the period for comment. The final EIS consists of the EIS and Additional Information to the EIS (AEIS). The final EIS was lodged with the Commonwealth Department of the Environment in accordance with section 104(3) of the EPBC Act.
